Basic provisions

• These purchase and sale rules (hereinafter – the Rules) determine the mutual rights, duties and responsibilities of the person purchasing goods in the www.hempspectrumbaltics.com electronic store (hereinafter – the Buyer) and UAB “HEMP SPECTRUM BALTICS” (here in after – the Seller). By purchasing goods in the online store, the Buyer agrees to the application of these Rules.

• The purchase and sale agreement between the Buyer and the Seller is considered concluded from the moment when the Buyer, after creating a shopping cart in the electronic store, specifying the delivery address, choosing a payment method and familiarizing himself with these Rules, clicks the “Pay” button, and is valid until the full obligations under this agreement execution.

Seller’s rights and obligations

• The seller has the right to unilaterally change these Rules by publishing new Rules on the website of the electronic store. Changes take effect from the moment of publication for all transactions concluded after publication.

• The Seller undertakes to make efforts to enable the Buyer to properly use the services provided by the electronic store.

• The seller does not make any guarantees that the electronic store will operate without interruption or that data transmission will be error-free. The Seller is not responsible for any losses of the Buyer related to malfunctions of the electronic store and/or data transmission errors.

• The Seller, in the event of important circumstances, being unable to provide the ordered product to the Buyer, undertakes to offer a similar product or return the money paid by the Buyer within 3 working days. In this case, the Seller is released from responsibility for non-delivery of the goods.

• The seller has other rights and obligations stipulated in the Rules and legal acts of the Republic of Lithuania.

Delivery of goods

• The goods are delivered within the EU by the courier company specified by the seller.

• Goods are sent to the Buyer within 1-4 working days after payment confirmation.

• In all cases, the Seller is released from responsibility for non-compliance with the terms of delivery of the goods, if the goods are not delivered to the Buyer or are delivered late due to the Buyer’s fault or due to circumstances beyond the Seller’s control.

• The buyer undertakes to accept the goods himself. Upon delivery of the goods to the address specified in the goods order application, the goods are deemed to have been properly delivered to the Buyer, regardless of whether the goods were actually accepted by the Buyer or any other person who accepted the goods at the specified address. In this case, the Buyer has no right to make claims against the Seller regarding the delivery of the goods to the wrong entity and/or other claims related to the delivery.

• When accepting the goods, the buyer must check the condition, quantity, quality, and completeness of the delivered goods together with the person delivering the goods. After observing/determining the quantity, quality, completeness, etc. of the goods. discrepancy, the Buyer must not accept the goods and note this in the goods transfer – acceptance documents. After the Buyer accepts the goods and signs the goods transfer – acceptance documents without comments, it is considered that the transferred goods are in good condition, without defects, the quantity, quality, and completeness of the goods meet the terms of the purchase – sale agreement and the Buyer has no claims against the Seller.

Returning the goods

• In the event that the product is of poor quality, the Buyer must inform about quality defects by e-mail. store administration within 48 hours by e-mail: [email protected] or by phone: +370 66968130.

• The goods are returned in the original packaging of the product and shipment together with the product documents. Before returning the goods, the buyer must contact the seller at the specified e-mail address. email [email protected]

• The Buyer is responsible for the proper assembly and packaging of the returned goods. If the product is not complete and/or properly packed, the Seller does not accept the returned product.

• The seller downloads the product of unsuitable quality at his own expense and replaces it with a product of suitable quality or returns the money paid for the product of unsuitable quality to the Buyer. The product balance cannot be less than 95%.

• In the event that the Buyer requests a refund for returned goods of inappropriate quality, he must e-mail email [email protected] to submit a refund request. In the request for a refund, the Buyer must indicate: name, order number, name and quantity of the wrong product, and the reason for the return. The money to the Buyer is returned to the bank account from which the goods were paid for. The money is returned within 3 working days from the written (e-mail) request of the Buyer and the sending of the goods of inappropriate quality to the Seller.

• In all cases of return, the buyer must first contact the specified contacts and only after receiving information from the store manager, return via courier.

Shared responsibility

• The buyer is responsible for the correctness of the data provided in the registration form. The buyer assumes responsibility for the consequences arising from the incorrectness or inaccuracy of the data provided in the registration form.

• The parties are responsible for the violation of the purchase and sale contract concluded using the electronic store in accordance with the procedure established by the legal acts of the Republic of Lithuania.

• The seller is not responsible for the fact that the color, shape or other parameters of the goods displayed in the online store do not correspond to the real size, shape and color of the goods due to the characteristics of the display used by the Buyer.

Processing of personal data

• By pressing the “Pay” button, the Buyer confirms that he agrees to provide the Seller with his personal data and does not object to the Seller processing the Buyer’s personal data both for the purposes of identification of the Buyer, conclusion of contracts, execution (online trade) and direct marketing.

• The Seller indicates that the Seller will not process the personal codes of the Buyer (if he is a natural person) for the purpose of direct marketing.

• The buyer confirms that he is informed of his right to access his personal data processed by the Seller and how it is processed, to demand correction, destruction of his personal data or to stop the processing of his personal data when the data is processed in violation of the provisions of the law, to refuse to be their personal data is processed.

Sending information

The Seller sends all notifications to the e-mail address provided in the Buyer’s registration form.

• The buyer sends all messages and questions using the means of communication provided in the Seller’s online store e-mail [email protected]. We consult on weekdays from 9 a.m. to 5 p.m.

Final Provisions

• All disputes arising out of or related to the purchase and sale agreement between the Buyer and the Seller shall be resolved by negotiation. If it is not possible to reach an agreement, disagreements are resolved in accordance with the procedure established by the legal acts of the Republic of Lithuania.

• All textual and graphic information published in the online store www.hempspectrumbaltics.com is protected in accordance with the laws of the Republic of Lithuania and is the intellectual property of the Seller.
